Guilty! "Breach of trust" Guilty. "Fraudulent introduction of data in a computer system" Guilty. "Forgery and use of forgeries" Guilty. Him and only him. Yesterday, the Paris Correctional Court imposed a sentence of absolute severity against Jérôme Kerviel.
For judges, the ex-trader has no excuse, it is the sole responsibility of the 4.9 billion euros of losses incurred by the General society following his fraudulent actions. Jérôme Kerviel is therefore sentenced to five years in prison, including three farm, and for the colossal damages all that asked the Bank (EUR 4.9 billion). As a supplementary penalty, there never the right to exercise his profession: trader. The never-seen. At 2,000 euros per month (his current salary of consultant computer science), it will take to repay the Bank Jérôme Kerviel 170,000 years.

His lawyer, Olivier Metzner "outraged", immediately announced that he was going to appeal this judgment "unacceptable by his totally excessive." Jérôme Kerviel remains therefore free... but guilty of all. For counsel for the Bank, the judgment "is a kind of moral reparation". In the hearings, they had suggested that they do not heightens the sum demanded.
Yesterday, the reading of the judgment had begun in a heavy atmosphere. The first words were slammed, implacable: "Whereas the deficiency of the Société Générale in the establishment of limits in nominal, considered by the Banking Commission as a breach of (... /...)" cannot exonerate a trader his duty of transparency to the employer; that the failure of vigilance of the Bank of the follow-up to the only existing limits, operating as alert indicators, provided no Jérôme Kerviel the duty to inform his hierarchy of the reality of its overflows or back within the limits assigned to the desk.
"Misleading impassiveness.
Them are incurred by the ex-trader markets were, in fact, astronomical: 30 billion euros on two occasions in 2007 and 50 billion in the first eighteen days of January 2008. Several times the own funds of the Bank. Then, "by his deliberate action, it has jeopardized the solvency of the Bank employing 140,000 people which he belonged and whose future was seriously mortgaged", can be read in the judgment of 73 pages. And for judges, it is certain: "all (of) elements, unsuccessfully raised by the defence, do not infer that Société Générale had knowledge activities fraudulent of Jérôme Kerviel, or even that she could have suspect them."
Judges have no words to describe "misleading impassiveness", "permanent nerve", the "cynicism of the actions" of the former trader. Which the acts have "infringed the global economic order", no less. Jérôme Kerviel listening, arms crossed, a lightweight rictus on lips. After the reading of the judgment, he sat down to send a message.
During the three weeks of hearing from 8 to 25 June, it had ceased to proclaim that if, Yes, "he had lost the sense of reality" by engaging with money markets, the Bank, she "could not not know." Or even that it tolerated because "he was earning money in the Bank". One by one, methodically, Dominique Pauthe, the President of the tribunal, destroys these arguments (see judgment).
"Role reversal".
Finally, Dominique Pauthe addresses itself to the question he had asked at the end of the hearings in June: "Who are you, Mr Kerviel". Jérôme Kerviel is no longer a mystery. "Information and debates helped to establish that these facts are recorded in a genuine fraud system implemented by Jérôme Kerviel perfectly consistent", explains the tribunal. For him, Jérôme Kerviel "engaged in a total reversal of roles in positioning itself as a victim of a system which he said the creature", Sonny President, clearly exasperated by the communication strategy of the ex-trader.
Remains whether if, in the opposite direction, the extreme severity of judgment yet fully motivated in law, and the colossal amount of the damages awarded to Société Générale, will not allow the ex-trader again endorse the costume of victim to him like a glove.
